This Terms of Use Agreement applies to your access to and use of the applications and services provided by Rosy Star AI Limited (collectively, "Our Services").

Any disputes, claims, or requests for relief related to your use of our products shall be governed by and construed in accordance with the laws of the State of California and the Federal Arbitration Act, and shall not be subject to the applicable principles of the laws of any other jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods explicitly excludes this agreement. If you do not agree to this agreement, please do not access or use our services.

Please note that Rosy Star AI Limited reserves the right to modify this agreement at any time at its own discretion. When making changes, we will provide a new copy of the agreement on our website and mobile application. We will also update the "Last Updated" date at the top of the agreement. If we make any significant changes, we will also send you push notifications or display pop ups through the application. We may require you to agree to the updated agreement in a specific manner. If you do not agree to any changes after receiving the change notification, you should stop using the service, including the website and mobile applications. Otherwise, if you continue to use the service, including the website and mobile applications, it means that you accept such changes. Please regularly check the website to view the current agreement.

qualification

You must be at least 13 years old to access or use our services. If you are under the age of 18 (or the legal age of majority where you reside), you can only access or use our services under the supervision of your parents or legal guardians who have agreed to be bound by this agreement. If you are the parent or legal guardian of a user under the age of 18 (or legal majority), you agree to take full responsibility for the user's actions or omissions related to our services. If you access or use our services on behalf of another person or entity, you represent that you have the right to accept this agreement on behalf of that person or entity, and that person or entity agrees to be responsible to us in the event that you or any other person or entity violates this agreement.

Prohibited behaviors and contents

You will not violate any applicable laws, contracts, intellectual property rights, or other third-party rights, nor engage in any infringement behavior. You are fully responsible for your actions when accessing or using our services. You won't:

Engage in any harassment, threat, intimidation, plunder or tracking behavior;

Use our services in any way that may interfere, interrupt, negatively affect or inhibit other users from fully enjoying our services, or damage, disable, overload or impair the functionality of our services in any way;

Reverse engineer any aspect of our services, or do anything that may discover source code or bypass or circumvent measures to prevent or restrict access to any part of our services;

Attempting to circumvent any content filtering techniques we use, or attempting to access any features or areas of our services that you are not authorized to access;

Without our prior written consent, develop or use any third-party applications that interact with our services, including any scripts designed to crawl or extract data from our services;

Use our services for any illegal or unauthorized purposes, or engage in, encourage or promote any activities that violate this agreement.

You can only publish or share non confidential user content in other ways, and you have all necessary disclosure rights. You are not allowed to create, publish, store, or share any of the following user content:

Illegal, defamatory, defamatory, obscene, pornographic, indecent, obscene, suggestive, harassing, threatening, infringing on privacy or public rights, insulting, inciting or defrauding;

Constitute, encourage or direct criminal offenses, infringe upon the rights of any party, or otherwise incur liability or violate any local, state, national or international law;

May infringe upon any patent, trademark, trade secret, copyright or other intellectual property or proprietary rights of either party;

Include or describe any statements, comments, or statements that do not reflect your true views and experiences;

Impersonate or distort your relationship with any individual or entity;

Include any unauthorized promotions, political campaigns, advertisements, or solicitations;

Without the consent of a third party, including any personal or personal information of a third party;

Contains any viruses, damaged data, or other harmful, destructive, or destructive files or content; perhaps

Based on our judgment, this behavior is offensive, or restricts or prohibits any other person from using or enjoying our services, or may cause any type of harm or liability to Lyrebird Studio or others.

Disclaimers

We do not control, endorse, or assume responsibility for any user content or third-party content provided or linked to our services.

You bear the risk of using our services on your own. Our services are provided "as is" and "as available" without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, ownership, and non infringement. Furthermore, we do not represent or guarantee that our services are accurate, complete, reliable, up-to-date, or error free. Although we attempt to ensure your safe access and use of our services, we cannot and do not guarantee that our services or servers are free from viruses or other harmful substances. You bear all risks of service quality and performance.

limitation of liability

According to any liability theory, whether based on contract, tort, negligence, strict liability, warranty or other reasons, we shall not be liable to you for any indirect, consequential, punitive, incidental, punitive or special damages or loss of profits, even if we have been informed of the possibility of such damages.

Rosy Start AI Limited's full liability for any claims arising from or related to this Agreement or our services, regardless of the form of litigation, shall be limited to the amount paid by you for accessing or using our services (if any).

The limitations set forth in this section shall not limit or exclude the liability of Rosy Start AI Limited for gross negligence, fraud, or intentional misconduct, nor shall they limit or exempt the liability for any other matter that cannot be excluded or limited under applicable law. In addition, some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

release

To the maximum extent permitted by applicable law, you release Rosy Start AI Limited from all known and unknown liabilities, obligations, claims, demands, and/or damages (actual and indirect) (including but not limited to negligence claims) arising from or related to disputes between users and the actions or omissions of third parties. You expressly waive any rights that you may have under Section 1542 of the California Civil Code and any other regulations or common law principles that would otherwise limit the coverage of this disclaimer to only claims that you may know or suspect to be beneficial to you at the time of agreeing to this disclaimer.

Transmission and processing of data

By accessing or using our services, you acknowledge and agree (if applicable) to the processing, transmission, and storage of information about you in the United States and other countries.

electronic communication

By accessing or using the service, you also agree to receive electronic communications from Rosy Start AI Limited (such as responding to your requests, questions and feedback, announcements, updates, and security alerts through push notifications or posting notifications on our service). You agree that any notices, agreements, disclosures, or other communications we send to you electronically will meet any legal communication requirements, including but not limited to such communications being in writing.

termination

We reserve the right to terminate your access or use of our services at our sole discretion without prior notice. We are not responsible for any loss or injury caused by your inability to access or use our services.

severability

If any provision or part of this Agreement is illegal, invalid or unenforceable, such provision or part shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any other provision.

Paid subscription

Rosy Start AI Limited's services may include paid subscriptions that allow you to access enhanced levels of Rosy Start AI Limited services. Paying fees to Rosy Start AI Limited for enhanced levels of Rosy Start AI Limited services does not change the service license granted to you by Rosy Start AI Limited under the terms.

The Rosy Start AI Limited service that can be accessed after payment requires payment of certain fees that we may determine from time to time, which should be paid by credit card or other payment methods accepted or instructed by Rosy Start AI Limited. Unless otherwise specified by Rosy Start AI Limited, all subscription fees are quoted in US dollars. The subscription fee does not include all taxes and should be borne by you.

The paid subscriptions for these Rosy Start AI Limited services are based on automatic renewal. Therefore, unless cancelled according to your subscription terms, your subscription will automatically renew at the end of the applicable subscription period (e.g. year) corresponding to the subscription period. If your subscription renewal starts on a day outside of a certain month, we will charge you on the last day of that month. You acknowledge and agree that due to free trials and other promotional offers, points applied to your account, and changes to your subscription, the time and amount of your billing may vary. You hereby authorize us to charge you the corresponding amount. You are fully responsible for ensuring that your billing and payment information is correct to prevent your subscription from being cancelled. If for any reason (such as expiration or insufficient funds) we are unable to charge you for your payment method and you have not cancelled your subscription, you will still be responsible for any outstanding amount, and we will attempt to charge you for the payment method fee as you may update your payment method information. This may result in a change in the start time of your next subscription period and may alter the billing date for each subscription period. If we are unable to successfully collect the renewal fee from your payment method, we reserve the right to cancel your subscription. After the subscription ends, you will not be able to access the Rosy Start AI Limited service that requires a subscription.

If we offer promotions or promotional prices for your subscription, when you choose a subscription plan and agree to the additional terms provided to you, the specific terms of the promotion will be disclosed or provided to you, and the specific promotions of the subscription plan you choose will be described. In the case of promotional pricing, we will charge you a subscription fee at the normal price after your promotion ends, unless you cancel your subscription before the promotion ends.

We reserve the right to change, modify, or alter the prices, packages, and features of the service subscription plans we provide from time to time. If we change or modify the price and package of such subscription plans, we will notify you in advance of the applicable changes or modifications. You can stop using services under the subscription plan at any time and request to cancel your subscription to such services. We are not responsible for reimbursing the cost of canceling your subscription.
